A young female athlete girl breaks her leg playing soccer. After treating the fracture the doctor sees the potential of a more serious condition and calls her back. While he is doing the tests she begins to study the diagnosis, treatment and outcome of the treatment and in doing so she encounters something disturbing. Are all the surgeries being done for this condition necessary?

DAY 79

At breakfast the next morning Kathy bowed her head with the family as Harry blessed the food. Kathy had a smile that was captivating. Leah mentioned that she was glad Kathy seemed to be better. Kathy responded. “Laura and I prayed together last night. It is the first time I have ever felt God heard me.”

After breakfast Laura gathered up the papers she printed the night before. Laura met Terri in the hall about twenty minutes to nine. Kathy watched and listened as they talked. Sam joined them and they looked over the papers. Finally he nodded to Terri.

“It’s yours today. You cross examine him. You were preparing to do that, weren’t you?”

Terri looked stunned. “Well, I prepared, in case you, well, are you sure you really want me to do that?”

“Yes. You are the right person to do it. But don’t use any of this till you get him on the record that this is definite and he used the lab document to determine which slides to use.”

“That is the approach I planned. But I was expecting to just back you up.”

“I think the time has come for me to sit this one out. The jury has seen enough of me.”

They headed into the courtroom.

The court opened and Terri got up. “Dr. Dromen, overnight I have looked at your credentials and they are impressive.”

The doctor smiled. “Thank you.” Terri had met with her first success. She had made contact with the doctor. She intended to discredit the basis for his testimony, not his expertise. It was better if he were friendly.

“Doctor, do you have a daughter?”

“Objection. Not relevant.” It was the lead of the HMO team.

Terri was there. “Your honor, this is to lay the groundwork for my questioning. It goes to the doctor’s confidence in the testing. Since he is an expert in this, his opinion is valuable.”

“Overruled.”

“Doctor, do you have a daughter?”

“Yes.”

“Assume for a moment you had not verified the tests. If your daughter were to be given a diagnosis of cancer of the femur and amputation was the recommended treatment would you tell her to have the surgery based on this test alone, number 10346?”

The doctor looked at his records. “No.”

“If that daughter were to be given a diagnosis of cancer of the femur and amputation were the recommended treatment would you tell her to have the surgery based on this test alone, number 10371?”
