Law: Creative Writing Assignment pt 6

Before anything else could happen I was thought back to grade 12 law with Oldfield. I remembered going through so many defences one could use in situations like mine. There were things like Mistake of Fact. This is where someone has made a genuine honest mistake, so the mens rea, which is the intention of committing the act, is not present. Since I knew exactly what I was getting myself into I knew that excuse was useless to me. There is also Automatism, where one can argue they had no control over their own body. It’s where somebody’s mind and body do not work as one; sleepwalking would be a good example of this. Though this too was no use for me, I knew what I was doing. The one excuse I could use though is Duress. This is where I can argue that I did what I did to achieve a greater good. My mom was in the hospital dying and we don’t have the money to continue on with her medication. Plus the bad people my dad was mixed in with before he died were also after us repeatedly demanding for money. I was pushed by all this to do what I had done. I knew this defence would be the one I would use. I’m hoping that I will get off the hook this one time, wish me luck!
