In the olden days, everybody smoked. As the years go by, and doctors are warning us more of the bad health effects, more people are quitting. See here a lady who eventually made a smoker move out of her home.

A Dallas lady, Chris Daniels, submitted a lawsuit against her landlord and her former neighbor. The suit claims the adjoining townhouse has some sort of building imperfection and her neighbor’s cigarette smoke was coming through the walls to her townhouse.

Townhouses industry groups all around the Dallas area are watching this court case.  Aafter a ruling, they will know what to do if it ever happens again.

Chris Daniels,  before she moved out,  after the smoker moved, lived in a group of 52 buildings near Preston wood Country Club in North Dallas.

A lawyer for Daniels group of buildings and a manager from them thinks their is a slight chance smoke got through the walls and caused harm. This is because their is a two hour fire wall from ceiling to floor between the houses.

It is interesting to note that after the problem started, they renewed their lease. If it was as bad as she makes it sound, she should  move  out.

Daniels and her daughter claim for a year they had breathing difficulty, sinus pain and stinging eyes. They also claim that they need all their artwork restored, clothes dry cleaned and the furniture re-upholstered. She is now filing for the  special care the disabled get because of her sensitivity to smoke.  That has not been resolved yet.

Whatever happened to the smoker? She moved out after a judge told her she couldn’t smoke in her house anymore.

Is Daniels a whiner looking for money or do you think she has that much sensitivity to cigarette smoke?

    I don’t think she is a whiner, I hope she wins her case as well as being harmful to health cigarette smoke stinks and if it gets into your belongings it is very hard to get rid of it. If she was renting it was the responsibility of the company to keep her safe so I don’t see why she should have to move out to solve the problem.

    if she smoked when she moved in and they knew about it then i think they should leave her alone to smoke and change the rules once she has gone on her own accord.

    I find myself feeling bad the lady had such allergies but, at the same time I feel bad for the smoker. I guess I see both sides of the issue..

    I think the complainer had a legal right to get relief. We live in an apartment and I am very sensitive to cigarette smoke. When people smoke out on their decks in summer. I lose the use of my deck and I can’t open my windows. I have never complained but I would if the smoke came inside my apartment. In fact I might do it when summer comes again. I don’t think it’s fair that I’m deprived of the use of my deck in the summer when I need it most. I pay rent too.

    Ruby, After some thought, I decided that the non smoker shouldn’t have put up with this smoker.
